This Privacy Policy explains how Percevra ("Percevra," "we," "us," or "our") collects, uses, discloses, and protects personal information when you use the Percevra website, application, and related services (collectively, the "Service").
By using the Service, you acknowledge the practices described in this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the Service.
1. Information We Collect
We may collect the following categories of information:
Information you provide
- Account information, such as your email address, display name, profile image, and authentication information. Passwords may be processed by our authentication provider and are not available to us in readable form.
- User content, such as color palettes, saved colors, preferences, uploaded images, project information, and other content you create, submit, or store through the Service.
- Communications, including information you provide when you contact us for support, privacy requests, or other inquiries.
- Transaction information, if you purchase a paid service. Payments are processed by a payment provider; we do not directly store complete payment-card details.
Information collected automatically
When you use the Service, we and the providers that support its operation may automatically collect:
- Device and browser information, such as device type, operating system, browser type, language, and general settings.
- Usage information, such as pages or features used, interactions with the Service, referring pages, and approximate timestamps.
- Network and diagnostic information, such as IP address, log data, crash reports, error reports, and security events.
- Essential storage data, such as session identifiers and preferences used to keep you signed in, maintain security, and remember workspace state.
2. How We Use Information
We may use personal information to:
- Provide, maintain, and operate the Service.
- Create and manage accounts and authenticate users.
- Generate, save, display, and manage palettes, projects, uploaded images, and preferences.
- Process subscriptions or purchases and maintain transaction records.
- Send transactional communications, such as account, security, billing, and password-reset messages.
- Respond to support requests and other communications.
- Understand feature usage and improve the performance, reliability, accessibility, and design of the Service.
- Detect, investigate, and prevent fraud, abuse, security incidents, and violations of our Terms of Use.
- Comply with legal obligations and enforce our rights.
We do not use uploaded images, palettes, or project content to train generative artificial-intelligence models unless we first update this Privacy Policy and provide any notice or choice required by law.
3. Cookies and Similar Technologies
The Service uses cookies, local storage, or similar technologies that are necessary to authenticate users, protect the Service, maintain sessions, remember preferences, and preserve workspace state.
We do not currently use third-party advertising cookies or sell personal information for cross-context behavioral advertising. If these practices change, we will update this Privacy Policy and provide any notice or choices required by law.
Because the Service does not currently engage in cross-site behavioral advertising, it may not respond to legacy browser Do Not Track signals. Where legally required, we will process recognized opt-out preference signals, such as the Global Privacy Control, as a request to opt out of applicable sale or sharing activities.
4. How We Disclose Information
We may disclose personal information in the following circumstances:
- Service providers. We may provide information to vendors that perform services on our behalf, such as cloud hosting, data storage, authentication, email delivery, error monitoring, security, analytics, customer support, and payment processing. These providers may use the information only as permitted by their agreements with us and applicable law.
- Legal and safety reasons. We may disclose information when we reasonably believe it is necessary to comply with law, regulation, subpoena, court order, or other legal process; protect the rights, safety, and property of Percevra, our users, or others; or investigate fraud, abuse, or security incidents.
- Business transfers. If Percevra is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be disclosed or transferred as part of that transaction, subject to applicable law.
- At your direction. We may disclose information when you ask us to do so or give us permission.
We do not sell personal information. We also do not knowingly share personal information for cross-context behavioral advertising.
5. Data Retention
We retain personal information for as long as reasonably necessary to provide the Service, maintain security, resolve disputes, enforce agreements, and comply with legal, tax, accounting, or reporting obligations.
Retention periods vary based on the type of information and why it was collected. When information is no longer required, we will delete or anonymize it where reasonably practicable. Residual copies may remain temporarily in backups or be retained where required by law.
6. Data Security
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, and disclosure. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
You are responsible for keeping your account credentials confidential and for notifying us if you believe your account has been compromised.
7. Your Choices and Privacy Rights
Depending on where you live and subject to applicable exceptions, you may have the right to:
- Request access to or a copy of your personal information.
- Request correction of inaccurate personal information.
- Request deletion of your personal information or account.
- Request information about how we use and disclose personal information.
- Obtain certain information in a portable format.
- Opt out of certain processing, where applicable.
- Appeal our decision regarding a privacy request, where applicable.
- Withdraw consent where processing is based on consent.
To submit a privacy request or request account deletion, email support@percevra.com. Please describe your request and provide enough information for us to identify your account. We may need to verify your identity before completing the request. You may use an authorized agent where permitted by law, but we may require proof of authorization and identity verification.
We will respond within the period required by applicable law. We may retain information when necessary to comply with legal obligations, prevent fraud, resolve disputes, protect security, or exercise legal rights. You will not receive discriminatory treatment for exercising an applicable privacy right.
If we deny a request and applicable law gives you a right to appeal, you may appeal by replying to our decision or emailing support@percevra.com with the subject line "Privacy Request Appeal."
8. Children's Privacy
The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided personal information to us, contact support@percevra.com, and we will take appropriate steps to delete it.
9. International Data Transfers
Percevra and its service providers may process and store information in the United States and other countries where they operate. These countries may have data-protection laws that differ from those in your location. Where required, we use appropriate safeguards for international transfers.
10. Third-Party Services and Links
The Service may contain links to third-party websites or integrate with third-party services. Their privacy practices are governed by their own policies, not this Privacy Policy. We encourage you to review those policies before providing personal information.
11. Changes to This Privacy Policy
We may update this Privacy Policy to reflect changes to the Service, our practices, or applicable law. When we do, we will update the "Last updated" date above and post the revised policy through the Service. If changes materially affect your privacy rights, we will provide additional notice where required by law.
